This second volume of the AIIB Yearbook of International Law examines the role of international organizations in promoting effective dispute resolution.

The essays in this book, originally published in a special issue of the journal International Negotiation (vol. 23.1, 2018), are intended to enhance America's ability to mediate Israel-Palestine conflict. Every American president for the last thirty years, down to Donald Trump, has chosen to engage in this effort. To help understand and evaluate these efforts, and to focus upon the more promising mediation directions, these essays analyze mediation options in detail.

There is an ever-present threat of catastrophic marine pollution incidents, as illustrated by recent disasters such as the Deepwater Horizon oil spill in the Gulf of Mexico. Even small-scale accidental pollution discharges can have long-term consequences for marine and coastal resources. The UN Convention on the Law of Sea obliges all States to cooperate to prevent accidents and to minimize environmental damage during emergencies by jointly developing and implementing marine pollution contingency plans.

Corporate social and environmental responsibility (CSR/CER) can be understood as practices which voluntarily extend beyond mere compliance with mandatory social and environmental standards. Corporate social and environmental responsibility: Another road to China's sustainable development, by Mengxing Lu, contributes to the current debate of CSR/CER by providing a legal and economic analysis of CSR/CER and its relationship with regulation. Although the development of CSR/CER is at an early juncture in China, it is nevertheless a prominent topic for Chinese policy makers and business leaders alike. By depicting the landscape of CSR/CER in China, Corporate social and environmental responsibility: Another road to China's sustainable development successfully demonstrates the vast potential for CSR/CER's contribution to China's sustainable development.

Multilateral development banks and other development agencies have adopted environmental and social safeguard policies setting due diligence standards for the provision of project finance. Such policies are evolving in terms of the activities covered and in their normative requirements. This edited volume presents a series of in-depth examinations by leading experts from banking institutions, academia and civil society, of key aspects of the rapidly evolving practice of IAMs, and of the implications of such practice for environmental and social governance.

This first volume of the AIIB Yearbook of International Law (AYIL), edited by Peter Quayle and Xuan Gao, is based upon the inaugural 2017 AIIB Legal Conference, both titled, Good Governance and Modern International Financial Institutions (IFIs). Following a Preface by the General Counsel of the AIIB and General Editor of AYIL, Gerard Sanders, and an Introduction by the Editors, this volume of AYIL draws upon expertise from other IFIs, international law and governance practitioners, and eminent academics.

Human and Societal Security in the Circumpolar Arctic addresses a comprehensive understanding of security in the Arctic, with a particular focus on one of its sub-regions - the Barents region. The book presents a comparative and interdisciplinary perspective to which the Arctic is placed as referent, and special attention is paid to the viewpoint of local and indigenous communities. Overarching topics of human and societal security are touched upon from various angles and disciplinary approaches, The discussions are framed in the broader context of security studies. The volume specifically addresses the challenges facing the Arctic population which are important to be looked at from human security perspectives.

This 10th thematic issue of International Development Policy presents a collection of articles exploring some of the complex development challenges associated with Africa's recent but extremely rapid pace of urbanisation that challenges still predominant but misleading images of Africa as a rural continent. Analysing urban settings through the diverse experiences and perspectives of inhabitants and stakeholders in cities across the continent, the authors consider the evolution of international development policy responses amidst the unique historical, social, economic and political contexts of Africa's urban development.

In Self-determination and Minority Rights in China, Linzhu Wang examines the rights of China's minorities from the perspective of self-determination. The book offers an insight into the ethnic issues in contemporary China, by examining the principle of self-determination in shaping China's ethnic grouping and appraising the rights of the minorities and their limits. Based on a comprehensive survey of the practice of self-determination in the Chinese context and the Regional Ethnic Autonomy regime, the author seeks to answer the questions of how the ethnic policies and laws have come to be, why they are problematic, and what can be done to promote minority rights in China.

This book is about the domestic dimension of public diplomacy, which must be understood within the context of public diplomacy's evolution over time. In the virtually connected world of today, newcomers such as supranational organizations, sub-states and Asian countries have had less difficulty than Western nation-states including a domestic dimension in public diplomacy. Doing so does not separate the domestic and international components; rather, it highlights that there is a holistic/integrative approach to public involvement at home and abroad. In Huijgh's comprehensive analysis, including case studies from North America, Europa and the Asia-Pacific, public diplomacy's international and domestic dimensions can be seen as stepping stones on a continuum of public participation that is central to international policymaking and conduct.

In The Ideas and Practices of the European Union's Structural Antidiplomacy, Steffen Bay Rasmussen offers a comprehensive analysis of EU diplomacy that goes beyond the functioning of the European External Action Service and discusses the sui generis nature of the EU as a diplomatic actor, the forms of bilateral and multilateral representation as well as the actor identity, founding ideas and meta-practices of EU diplomacy. The book employs a novel theoretical approach that distinguishes the social structures of diplomacy from the practices and meta-practices of diplomacy. Comparing EU diplomacy to the two theoretically constructed ideal types of Westphalian diplomacy and utopian antidiplomacy, Steffen Bay Rasmussen concludes that the EU's international agency constitutes a new form of diplomacy called structural antidiplomacy.

In European Small States and the Role of Consuls in the Age of Empire Aryo Makko argues that Sweden and Norway participated in the New Imperialism in the late 18th and early 19th centuries through consular services. Usually portrayed as nations without an imperial past, Makko demonstrates that their role in the processes of imperialism and colonialism during that period can be understood by including consular affairs and practices of informal imperialism into the analysis. With this, he contributes to our understanding of the role of smaller states in the so-called Age of Empire.

International organizations are typically intergovernmental in nature and endowed with a bipolar institutional structure where organs of States are usually juxtaposed with the Secretariat. On these premises, in Non-Governmental Interests in Regional Organizations, Elisa Tino aims at analysing the unexplored phenomenon of institutional multipolarism of regional organizations, namely the trend to establish institutions representing non-governmental interests.

In Intergenerational Equity: Environmental and Cultural Concerns, the editors have produced an important, broad-based volume on intergenerational equity. The authors explore the principle of intergenerational equity in many dimensions, from the theoretical to the practical. While the primary focus is on intergenerational equity in the context of environmental resources and cultural heritage, the principle is also addressed in a broad array of other contexts. The final section of the volume considers intergenerational justice as it applies to indigenous peoples, genocide, migration, sovereign wealth funds and foreign investment.

The ITLOS Yearbook 2018 provides information on the composition, jurisdiction, procedure and organization of the Tribunal and reports on its judicial activities in 2018, in particular concerning Case No. 25. The Yearbook is prepared by the Registry of the Tribunal.

The Chinese (Taiwan) Yearbook of International Law and Affairs includes articles and international law materials relating to the Republic of China on Taiwan and contemporary Asia-Pacific issues. This volume provides insight into the South China Sea Arbitration, cross-strait relations and Taiwan's New Southbound Policy. In Permutations of Responsibility in International Law the concept of responsibility in international law is tackled from a multitude of angles. The various contributions, which emerged from the proceedings of the ILA Hellenic Branch Regional Conference (2012), examine both classical and modern issues relating to the nature of responsibility, both as responsibility for unlawful acts and liability for lawful acts, the multifariousness of actors whose actions (or omissions) may give rise to responsibility, and finally the plethora of responsibility-related issues that have emerged in different areas of international law, be it international law of the sea, trade and investment or human rights law.

This book aims to investigate the way in which personality rights are protected in China through a comparative and cross-cultural lens drawing on perspectives from Europe and elsewhere in the world. Currently, the question whether or not to incorporate a special law on personal rights - the right to life, the right to health, and the rights to reputation and privacy - into a future Chinese Civil Code is heatedly debated in the Chinese legal community. The book offers a broad investigation of personality rights protection in both China and Europe and provides the first substantive comparison of the Chinese and European regimes.

In Broadcasters' Rights in the Digital Era, Sakthivel provides a cogent understanding into a hitherto unchartered territory on the applicability of copyright law on the live streaming of 'entertainment content'- an emerging medium of communication. The book examines in exhaustive breadth the scope of broadcasters' neighbouring rights under the copyright regime in the light of technological advancements vis- -vis authors' right and explores the experiences of EU & USA and then suggests suitable changes to the Indian Copyright regime. Sakthivel employs technological analysis and existence of differential market for different mediums to substantiate the relationship of live streaming and the copyright regime.

In The Requirement of Consultation with Indigenous Peoples in the ILO, Maria Victoria Cabrera Ormaza examines the law-making and interpretive practice of the International Labour Organization (ILO) relating to indigenous peoples with a particular focus on the consultation requirement established by Article 6 of ILO Convention No. 169. Taking into account both the mandate and institutional characteristics of the ILO, the author explains how the ILO understands the notion of consultation with indigenous peoples and outlines the flaws in its approach. Through a comprehensive analysis of state practice and human rights jurisprudence concerning indigenous peoples, the author explores the normative impact of ILO Convention No. 169, while revisiting the ILO's potential to help harmonize different interpretations of the consultation requirement.

On the occasion of the centenary of the International Labour Organization (ILO), this 11th special issue of International Development Policy explores the Organization's capacity for action, its effectiveness and its ability to adapt and innovate. The collection of thirteen articles, written by authors from around the world, covers three broad areas: the ILO's historic context and contemporary challenges; approaches and results in relation to labour and social protection; and the changes shaping the future of work. The articles highlight the progress and gaps to date, as well as the context and constraints faced by the ILO in its efforts to respond to the new dilemmas and challenges of the fourth industrial revolution, with regard to labour and social protection.

General Principles of Law in Investment Arbitration surveys the function of general principles in the field of international investment law, particularly in investment arbitration. The authors' analysis provides a representative case study of how this informal source operates alongside and in the absence of other sources of applicable law. The contributions are divided into two parts, devoted respectively to substantive principles and procedural ones. The principles discussed in the book are selected for their currency in the practice, their contested nature and their relevance.

In Ius Doni in International Law and EU Law, Dr. Christian H. K lin establishes the concept of ius doni in the contemporary legal and political theorising of citizenship. Providing a comprehensive analysis of the subject, the book discusses the legal and political concepts of citizenship. It also introduces a new term for what is already an increasingly common and accepted practice of granting citizenship on the basis of substantial contributions to the State. Consisting of two main parts - law and practice - the monograph analyses the ius doni concept in both international law and EU law, further tests its application in practice and establishes best practices among states.

Growing religious antagonisms are challenging the ultimate goal of 'living together' in peaceful societies. Religion and International Law explores international law responses, beginning with their historic roots, before the perspective shifts to the role of religious institutions and religious law. Contributions of different human rights bodies are analyzed, before further sections deal with the international protection of religion, the relationship between religious beliefs and freedom of expression, and the roles of other individual rights.

The Ecosystem Approach in Ocean Planning and Governance takes stock of the challenges associated with implementing an ecosystem approach in ocean governance. In addition to theorizing the notion of Ecosystem Approach and its multifaceted implications, the book provides in depth analyses of lessons learned and remaining challenges associated with making the Ecosystem Approach fully relevant and operational in different marine policy fields, including marine spatial planning, fisheries, and biodiversity protection.

In The Marine Environment and United Nations Sustainable Development Goal 14, leading marine experts assess the scope, achievements, and limitations of UNSDG 14 for the conservation and sustainable use of marine resources. Chapters discuss the challenges and gaps of ocean governance through five key sections: Conservation and Sustainable Use of Oceans and Their Resources; Biodiversity beyond National Jurisdiction; Status of Deep Seabed Minerals; Marine Pollution and Coastal Ecosystems; and Climate Change and the Oceans.

In Governance of Offshore Freshwater Resources Ren e Martin-Nagle presents the scientific proof for vast quantities of freshwater in the seabeds, explains the socio-economic factors that will lead to development of the resource, and examines the international law principles and regimes that would guide policymakers in designing a governance system for offshore freshwater. Pursuant to the law of the sea, coastal states have sovereign rights to seabed resources within their exclusive economic zones. Offshore hydrocarbon development has produced customary practices for cooperation that were inspired by international water law and that could serve as a template for governing transboundary offshore freshwater. Given the vital nature of freshwater, equitable distribution of this new resource and its benefits should be considered.

In Sustainable Ocean Resource Governance an international group of eminent authors offer perspectives on the legal interface between sustainable economic growth, effective marine resource management and urgent environmental protection of the sea by addressing three key issues: deep sea mining, marine energy generation, and seabed pipeline and cable systems. In light of the sectoral nature of current ocean governance and the existing patchwork of management arrangements for the oceans, this book gives insights in search for a coherent and consistent sustainability approach.

The Exploitation of Marine Genetic Resources in Areas beyond National Jurisdiction by Val rie Wyssbrod begins by identifying the legal regime applicable to these underexploited resources which offer vast potential for the development of new drugs, bioplastics, depolluting products and other innovations. The author then outlines provisions for a new treaty, currently under discussion at the UN and presents alternatives to a new regime including revised legal instruments, the development of soft law and the creation of an applicable ecolabel.

Since 2006 the United Nations General Assembly (UNGA) has been discussing the question of the conservation and sustainable use of biodiversity in areas beyond national jurisdiction. Following the issues raised by the Ad Hoc Working Group (2006 - 2015) and the Preparatory Commission (2016 - 2017) in 2017 the UNGA agreed to convene an intergovernmental conference to discuss these issues. Conserving Biodiversity in Areas beyond National Jurisdiction, edited by David Freestone, brings together a collection of essays covering some of the key issues involved in these debates.

In Drafting Successful Access and Benefit-sharing Contracts, Young and Tvedt offer an insightful and profound analysis of how ABS can be made truly functional through the use of legally binding and enforceable contracts. Contracts are foreseen as the main legal tool for making access and benefit sharing work, thus realizing the third objective of the Convention on Biological Diversity. Many years have gone by since contracts were first suggested as a solution to resolve the challenges of ABS, but so far few successful benefit-sharing cases have been presented. This volume explores the possibilities and limits of contract law which both practitioners and stakeholders need in order for ABS contracts to become an effective solution for sustainable use of biological diversity.

Cross-border Water Trade: Legal and Interdisciplinary Perspectives is a critical assessment of one of the growing problems faced by the international community -- the global water deficit. Cross-border water trade is a solution that generates ethical and economic but also legal challenges. Economic, humanitarian and environmental approaches each highlight different and sometimes conflicting aspects of the international commercialization of water. Finding an equilibrium for all the dimensions required an interdisciplinary path incorporating certain perspectives of natural law. The significance of such theoretical underpinnings is not merely academic but also quite practical, with concrete consequences for the legal status of water and its fitness for international trade.

Antarctica's wilderness values, even though specifically recognized by the Environmental Protocol to the Antarctic Treaty, are rarely considered in practice. This deficiency is especially apparent with regard to a more and more increasing human footprint caused, among others, by a growing number of tourists visiting the region and conducting a broad variety of activities. On the basis of a detailed study of three Arctic wilderness areas - the Hammastunturi Wilderness Reserve (Finland), the Archipelago of Svalbard (Norway) and the Denali National Park and Preserve (Alaska, United States) - as well as the relevant policies and legislation in these countries, Antje Neumann identifies numerous 'lessons learnt' that can serve as suggestions for improving the protection of wilderness in Antarctica.

High Seas Governance: Gaps and Challenges identifies gaps in and challenges to the existing legal regime in the protection and preservation of the marine environment of the high seas, including sensitive marine areas. The gaps identified in the book include the failure of liability and compensation schemes to cover pollution of the high seas and the fact that no state has the responsibility to clean up pollution of the high seas. One common theme of the book is that it is necessary to identify a state other than flag states, port states or coastal states, which should have an obligation to exercise jurisdiction and control over certain activities on the high seas.

The Montreal Protocol, which is based on the Vienna Ozone Convention, is known as one of the most successful environmental treaties in the history of international law. These treaties, together with non-binding instruments adopted by the MOP/COP, have gradually formed the so-called 'ozone régime' and have exerted a significant influence on the international legal order. In the second revised edition, the author provides a detailed analysis of the developments in the ozone régime after the adoption of the 1999 Beijing Amendments, including the operation of the Non-Compliance Procedure and the Kigali Amendment on a global phase-down of HFCs.

In a fresh and original account, Lloyd Freeburn challenges the conventional conception of contracts as the consent-based legal foundation of international sports law. The prevailing legal orthodoxy is shown to be untenable, failing to explain or justify international sports governing bodies' regulatory power or their control over the livelihoods and liberty of participants in sport. The non-consensual jurisdiction of the Court of Arbitration for Sport is similarly tainted. But this significant challenge is not made simply to undermine international sport's regulatory regime. A sound legal foundation for regulatory authority in sport is both desirable and necessary. Consequently, effective reform is urgently required to support the regime's legality and to give it legitimacy by resolving the regime's democratic deficit.

Since the 1980's, States have been increasingly concerned with ensuring appropriate protection of underwater cultural heritage, endangered by anthropogenic activities reaching ever deeper ocean waters. The localisation of certain sites in the high seas has raised jurisdictional claims, sometimes grounded on an extension of connected factors (spatial and "extra-spatial") already recognized in general international law and in the law of the sea, while other cases are based on hitherto purely factual links. But conventional and customary rules remain insufficient, either for a real delimitation of state's competences or for regulating the exercise of jurisdiction once authorized in a certain sphere.

The BRICS in the New International Legal Order on Investment: Reformers or Disruptorsis written by international experts with BRICS backgrounds. The book investigates why and how the BRICS countries modernize their approach to the investment treaty regime. The chapters are organized by BRICS countries and discuss whether they can develop a common approach to investment treaties as well as what these countries will bring to the investment treaty regime in the future. The volume provides important perspectives on how the BRICS, an emerging power hub in international society, engage in the international legal order.

Civil Society in Investment Treaty Arbitration: Status and Prospects provides an overview of the evolution of civil society's participation as amicus curiae before ICSID tribunals and ad hoc tribunals applying the UNCITRAL Arbitration Rules. That evolution fits within a broader movement towards transparency in investment treaty arbitration. By looking at the procedural roles available to civil society before other jurisdictions, the book questions whether the amicus role could be expanded. El-Hosseny ultimately shows how substance and procedure closely intertwine.

In Contractual Renegotiations and International Investment Arbitration, Aikaterini Florou explores the tangible and sensitive problem of the renegotiation of state contracts, and the relationship between those contracts and the overarching international investment treaties. By bringing novel insights from economics, the author deconstructs and decodes the contract-treaty interaction by showing that it is not only treaties that have an impact on the underlying contracts, but also those contracts have an effect on the way the open-textured treaty standards are interpreted.

In The Seal Hunt: Cultures, Economies and Legal Regimes, Nikolas Sellheim offers a deep analysis of the seal hunt worldwide. He engages on a journey from the northern to the southern hemisphere and explores how the seal hunt has shaped cultures all over the world up to this day. By analysing the different national and international regimes dealing with the seal hunt, Sellheim shows how the perception of the seal and the seal hunt has changed over time and space. Focusing on the European Union and the World Trade Organization, the volume offers an account on how opposition towards the seal hunt has found its way onto the international spheres of governance and trade.

Is international law equipped to tackle the challenges posed by the dramatic increase in disasters? In Disaster Management and International Space Law Diego Zannoni attempts to answer this crucial question through an analysis of the main legal issues involved, addressing both prevention and relief, with a special focus on major space applications such as remote sensing and telecommunications, and the attendant specific legal regimes. It is argued that, when lives of human beings are in danger, territorial sovereignty becomes, to a certain extent, porous and bends in front of the value of human life and the urgent need to rescue. On the other hand, specific obligations were identified to cooperate in the prevention and management of disasters, particularly in terms of data sharing.

Resolving Conflicts in the Law, edited by Chiara Giorgetti and Natalie Klein, honours the work of Professor Lea Brilmayer whose intellectual contribution and influence span scholarly debate and the practice of both public and private international law. The book's essays are from leading international law scholars and practitioners in the field--including Michael Reisman, Stephen Schwebel, Erin O'Connor O'Hara, John Crook, Philippa Webb, Kermit Roosevelt, Harold Koh--and reflect on contemporary and cutting-edge questions of international law. Each contribution enriches and advances scholarly debate on topics of law for which Lea Brilmayer is well known, including: international dispute settlement; conflicts of law; international relations theory; secession and territorial and maritime sovereignty.

International Law and Islam: Historical Explorations offers a unique opportunity to examine the Islamic contribution to the development of international law in historical perspective. Islamic Commercial Law: Contemporariness, Normativeness and Competence offers new perspectives on why for centuries Islamic commercial law has been perceived as arbitrary and unpredictable, and on its evolution to a contemporary, consistent, reliable and credible body of law. The book also examines why Western positivists have viewed Islamic commercial law in a simplistic or archaic religious framework and counters those arguments with an examination of its normative legal qualities. The work analyses the competencies of Fiqh (jurisprudence) for structuring new financial instruments, and restructuring conventional financial products more equitability.

In the only analysis of its kind, Dr. Maria-Vittoria "Giugi" Carminati asks the question: if a commercial space operator kills or injures one of its spaceflight participants or a crewmember, what is the extent of the operator's liability? In the United States, that question has no clear answer. Dr. Carminati explores the way the United States manages liability, at state and federal level, and from state to state. Tort law in the United States exists at the state level. However, commercial spaceflight and its regulation are creatures of federal law. Understanding how these two systems interact and, often, conflict is critical to understanding how commercial spaceflight operators can manage exposure.

In The External Dimension of EU Social Security Coordination: Towards a Common EU Approach, Pauline Melin provides a detailed legal analysis of the framework on social security coordination with third countries and offers alternative policy solutions to the current fragmented approach. The analysis comprises a complete overview of the EU approach to social security coordination with third countries, 9 bilateral agreements (between Belgium, Germany, and the Netherlands, with respectively India, Turkey, and USA) and international standards. Based on this analysis, the author explores the possibility from an institutional perspective to develop a common EU approach through the conclusion of EU agreements.

In the Court of Justice of the European Union, Subsidiarity and Proportionality Kate Shaw sets out how a subsidiarity and proportionality review applied to competences could be anchored by the Court of Justice when balancing the competing interests in cases concerning the residency rights of EU citizens. The book also considers the extent to which a court which is dedicated to enhancing the European project is really able to be an independent arbiter between the EU and the Member States in this context. Both the legal reasoning of the Court and the controversial nature of residency rights of EU citizens are legally and politically very topical at the moment and of interest to legal academics and law students.

In Climate Border Adjustments and WTO Law, Ulrike Will develops a convincing reform proposal for a climate border adjustment (BA) on imports within the EU Emission Trading System (ETS). The proposed framework offers a realistic approach which would be immune to disputes at the WTO and comply with international climate agreements while remaining economically feasible and straightforward to implement. The book offers a comprehensive analysis of the WTO cases that might have parallels to the unresolved case of BAs.

While forces of globalization have created a genuine global marketplace, global rules safeguarding the competitive process in this marketplace have not emerged. International cooperation among national regulators and enforcers is therefore needed to create a competitive global business-environment. The Future of International Competition Law Enforcement, using the variety of legal instruments available to the EU as a point of departure, undertakes an original assessment of the EU's cooperation agreements in the field of competition law The work's focus is on the bilateral sphere, often labelled as a mere 'interim-solution' awaiting a global agreement; further attention is given to competition provisions in free trade agreements as well as the main multilateral initiatives in this field, in order to determine their relative value.

In this monograph, Aiste Mickonyte examines the compliance of the European anti-cartel enforcement procedure with the presumption of innocence under Article 6(2) of the European Convention on Human Rights (ECHR). The author maintains that the pursuit of manifestly severe punishment with insistence of the European Commission on administrative-level procedural safeguards is inconsistent with the robust standards of protection under the Convention. Arguing that EU anti-cartel procedure is criminal within the meaning of the Convention, this work considers this procedure in light of the core elements of the presumption of innocence such as the burden of proof and the principle of fault. The author zeroes in on the de facto automatic liability of parental companies for offences committed by their subsidiaries.

This publication presents a comprehensive review of the life and intellectual legacy of the Dutch Nobel Peace laureate and father of the Hague tradition of international law. It is the first research study based on a wealth of recently disclosed private and family files, and deepens and modifies all earlier evaluations. Grain Subsidies in Ukraine is the first attempt to examine impact of international trade law on Ukrainian policies in the cereals sector. The author focuses on instruments of state support for agricultural producers. Those are examined in their compliance with Ukraine's WTO commitments. The other central component of the book is the effect of the EU-Ukraine Association Agreement on the the country's policy space. The treaty contains legal approximation provisions, which may have a farreaching impact on Ukrainian agricultural regulation. In this regard, the agreement is compared to other free trade agreements signed by Ukraine.

Legal education systems, like legal systems themselves, were framed across Asia without exception according to foreign models. These reflect the vestiges of colonialism, and can be said to amount to imitating the style and purposes of legal education typical in Western and relatively "pure" common law and civilian systems. Today, however, we see Asian legal education coming into its own and beginning to accept responsibility for designing curricula and approaches that fit the region's particular needs.

In National Trials of International Crimes in Bangladesh, Professor Islam examines the judgments of the trials held under a domestic legislation, which is uniquely distinct from international or hybrid trials of international crimes. The book, falling under international criminal law area, is a ground-breaking original work on the first ever such trials in the ICC era. The author shows how the national law and judgments can act as a conduit to import international law to enrich and harmonise the domestic law of Bangladesh; and whether the Bangladesh experience (a) creates any precedential effect for such trials in the future; (b) offers any lessons for the ICC complementarity; and (c) contributes to the progressive development of Asian and international criminal jurisprudence.

In Road Traffic Liability in China: A View from Law and Economics, Yu Yan provides an in-depth analysis of the Chinese road traffic liability system, as well as other alternative accident prevention schemes from a view of law and economics. The analysis refers to the functioning of the system both on paper and in practice. The conclusion shows that the current Chinese traffic liability system can only achieve partial deterrence, and that the problems of under-compensation and insufficient risk-spreading seem to be serious, at least in the economically underdeveloped regions. Based on these findings, Yu Yan suggests specific legislative changes to be taken for the policymakers to improve the system.

Advocating Social Change through International Law, edited by Professors Daniel Bradlow and David Hunter, explores the use of hard and soft international law in advocating for social change. Using case studies rooted in inter alia human rights, international crimes, environmental protection, public heath, and financial regulation, the book focuses on both state and non-state actors' strategic choices regarding the use of hard and soft international law in advocating for social change.

This treatise investigates the emergence of the early modern law of nations, focusing on Alberico Gentili's contribution to the same. A religious refugee and Regius Professor at the University of Oxford, Alberico Gentili (1552-1608) lived in difficult times of religious wars and political persecution. He discussed issues that were topical in his lifetime and remain so today, including the clash of civilizations, the conduct of war, and the maintenance of peace. His idealism and political pragmatism constitute the principal reasons for the continued interest in his work. Gentili's work is important for historical record, but also for better analysing and critically assessing the origins of international law and its current developments, as well as for elaborating its future trajectories.

The Historical Foundations of Grotius' Analysis of Delict explores the origins of a generalised model of liability for wrongdoing in the history of European private law. Using Grotius as its focal point, it analyses the extent to which earlier civilian and theological doctrine shaped his views. It divides Grotius' approach into three elements - the infringement of a right, fault, and remediation - and traces the development of parallel concepts in earlier traditions. It argues that Grotius was influenced by the writings of Thomists to a far greater extent than has previously been acknowledged, virtually eclipsing any sign of civilian influence except where Romanist learning had already been incorporated into theological doctrine.

Non-State Actors and International Obligations examines the contribution and relevance of non-state actors in the creation and implementation of international obligations. In Neutrality as a Policy Choice for Small/Weak Democracies: Learning from the Belgian Experience, Michael F. Palo has three main objectives. First, he employs a counterfactual approach to examine the hypothesis that had permanent neutrality not been imposed on Belgium in 1839, it would have pursued neutrality anyway until war broke out in 1914. Secondly, he analyses why, after abandoning obligatory neutrality during World War I, the Belgians adopted voluntary neutrality in October 1936. Finally, he seeks to use the historical Belgian case study to test specific International Relations' Theories and to contribute to Small State Studies, especially the behaviour of small/weak democracies in the international system.

The land Strait is a particularly important sea route connecting the Gulf of Bothnia with the Baltic Sea between Sweden and the land Islands. The land Strait is closely connected to the land Islands, which were demilitarised in the international legal treaty ending the Crimean War in the 1850s. Following World War I, the land Strait was also regulated by the 1921 Convention relating to the Non-fortification of and Neutralisation of the land Islands. This book is the first to examine passage rights in the land Strait according to the Law of the Sea and its long history in times of war and peace.

In 1999, the Alliance mistakenly bombed the Chinese embassy in Belgrade. Around the same period, allegations were made regarding its involvement in human trafficking and forced prostitution in Bosnia-Herzegovina. A decade later, NATO airplanes hit a fuel truck causing significant civilian casualties in Kunduz, Afghanistan. After more than 60 years of existence and a track-record of more than 30 missions performed worldwide, it is surprising that there is still uncertainty on the scope and content of NATO's responsibility for wrongful conduct during its military operations.

Actio Popularis before International Courts and Tribunals examines actio popularis in the context of the symbiotic relationship between procedural and substantive normativity in international law. Actio popularis is an important procedural tool devised to address the challenges posed by the relativization of substantive normativity and recognition of norms established to protect collective interests in international law.

In Corruption and Targeted Sanctions, Anton Moiseienko analyses the blacklisting of foreigners suspected of corruption and the prohibition of their entry into the sanctioning state from an international law perspective. The implications of such actions have been on the international agenda for years and have gained particular prominence with the adoption by the US and Canada of the so-called Magnitsky legislation in 2016. Across the Atlantic, several European states followed suit. The proliferation of anti-corruption entry sanctions has prompted a reappraisal of applicable human rights safeguards, along with issues of respect for official immunities and state sovereignty.

Conventional wisdom has it that the successful functioning of the UN Security Council almost completely depends on the role played by its five permanent members and the extent to which they can agree--or avoid to fundamentally disagree--on the many issues on the Council's agenda. But the Council also consists of ten non-permanent or elected members who represent five different regions of the world, and who, though not vested with the right of veto, play an indispensable role in Council decision-making. This book aims to take a closer look at that role.

State Responsibility for the Support of Armed Groups in the Commission of International Crimes examines the law on attribution of conduct of individuals to states. Under established principles of international law, State responsibility only arises where armed groups act under the direction or control of the State, or are completely dependent on the State. These tests are under inclusive as they do not consider the different ways states can exert control over armed groups in the commission of international crimes. Ramsundar presents an interesting examination into the possibility of liberalization of the rules of State responsibility.

In Revisiting the Law of Occupation, Hanne Cuyckens assesses the crucial challenges faced by the law of occupation. Through examples such as the occupation of the Palestinian Territories and the 2003 occupation of Iraq, the author convincingly demonstrates that although the law of occupation may no longer be perceived as adequate to address contemporary forms of occupation, a formal modification of the law is neither desirable nor feasible. The author identifies means by which the potential dichotomy between the law and the facts can be addressed without formal modification of the former: 1) flexible interpretation of the law itself; 2) the role of International Human Rights law as gap-filler; and 3) the role of the UNSC as a modulator of the law.

Parties negotiating the end of authoritarian regimes or armed conflicts are almost inevitably left in a situation of legal uncertainty. Despite their overlapping scope of application, the differences between the approaches of International Criminal Law (ICL) and Transitional Justice (TJ) are so profound that, unless dogmatisms are left aside and a process of dialogue is entered into, it will not be possible to harmonize the current legal regime of international crimes with the need to articulate transitional processes that are capable of effectively overcoming authoritarian regimes and armed conflicts.

In Piracy and the Origins of Universal Jurisdiction, Mark Chadwick relates a colourful account of how and why piracy on the high seas came to be considered an international crime, subject to the principle of universal jurisdiction prosecutable by any State in any circumstances. Merging international and domestic law, history, literature, and sociology, the author weaves an intricate tale that reveals the pirate to be the original "enemy of mankind" and forerunner of today's international criminals: those who commit genocide, crimes against humanity, war crimes and aggression. In so doing, Mark Chadwick proposes a convincing reappraisal of the pirate's role in the crystallisation of international criminal law, bringing much-needed clarity to a disputed area of international legal history.

In Peremptory Norms of International Law and Terrorism (Jus Cogens) and the Prohibition of Terrorism, Aniel de Beer analyses the role of these norms (jus cogens norms) in the fight against terrorism. Jus cogens norms protect fundamental values of the international community, are hierarchically superior and non-derogable. The author argues, based on an analysis of the sources of international law, that the prohibition of terrorism has become the jus cogens norm of our time. She further considers the impact of the status of the prohibition of terrorism as a jus cogens norm on other norms of international law relevant in the fight against terrorism, namely the prohibition of torture, the right to a fair trial and the prohibition of the inter-state use of force.

The Rome Statute of the ICC at its Twentieth Anniversary (Achievements and Perspectives) is an edited book comprising of 13 chapters written by contributors to a conference dedicated to discuss the development, achievements and possible future evolution of the Rome Statute and international criminal law. The authors include academics from various legal systems, practitioners from the ICC and the Special Tribunal for Lebanon, attorneys and other law experts. The International Criminal Court is the first universal international criminal tribunal. Though quite new, as the Rome Statute was adopted 20 years ago (1998) and only 16 years have passed since its entry into force, it has already developed interesting case-law and continues to elaborate on both substantive and procedural international criminal law.

Legal Order in the World's Oceans: UN Convention on the Law of the Sea assesses the impact of the 1982 Convention on the Law of the Sea (UNCLOS) and many aspects and challenges of modern law of the sea. The theme was selected in part to celebrate that this conference was the Center for Oceans Law and Policy's 40th Annual Conference and in part to emphasize the seminal contribution to the Rule of Law from UNCLOS in building legal order in the world's oceans.

The Belt and Road Initiative (BRI) put forward by China in 2013 includes the land-based 'Silk Road Economic Belt' and the ocean-based '21st-Century Maritime Silk Road' (MSR) which focuses on the promotion of cooperation between States along the Belt and the Road. As the UN Convention on the Law of the Sea (LOSC) has established the global maritime order, all ocean-related activities generating from the BRI projects along the MSR are in principle subject to the LOSC governance. The Belt and Road Initiative and the Law of the Sea discusses the use of oceans in the context of BRI covering navigational safety, marine energy and sea ports, maritime law enforcement and access of landlocked states to the sea.

'Global Commons' refers to resource domains or areas that lie outside of the political reach of any one State, including sea areas beyond national jurisdiction and Antarctica. The concept of 'global commons' is a living concept and can accommodate, over time, other commons at the international level, such as biodiversity and generic resources. The outlook for the global marine commons is not encouraging: fishery resources continue to deplete, marine biodiversity continues to reduce, and plastic wastes in the oceans continue to increase. In international law, there are legal regimes governing global marine commons, the most important of which is the 1982 United Nations Convention on the Law of the Sea (LOSC).

The Law of the Seabed reviews the most pressing legal questions raised by the use and protection of natural resources on and underneath the world's seabeds.
